COMBINED NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS AND FINAL NOTICE AND PUBLIC EXPLANATION OF A PROPOSED ACTIVITY IN A WETLAND FINAL NOTICE AND PUBLIC EXPLANATION OF A PROPOSED ACTIVITY IN A WETLAND This is to give notice that the Town of Brattleboro under Part 58 has conducted an evaluation as required by Executive Order 11990, in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management and/or Wetlands Protection. The activity is funded under the Community Development Block Grant (CDBG) (administered by the Vermont Community Development Program) under Title I of the Housing and Community Development Act of 1974 (PL 93-383), the National Affordable Housing Act, as amended. The proposed project is located at 343 John Seitz Drive in Brattleboro, Windham County. This project involves the expansion of an industrial building and driveway in the Exit 1 Industrial Park in Brattleboro located on a 10+ acre site. The existing building, with a 12,363 square foot footprint, will be renovated and expanded to a building totaling 35,460 square feet. The existing drive and truck entrance will be widened. In order to accommodate a wider drive, a portion of the entrance will encroach on a small area of a wetland that is on-site that is expected to be classified as a Class II wetland. The total number of acres of wetlands on site is 1.2 acres (51,730 square feet). This project will impact approximately 316 square feet of wetland. The Town of Brattleboro has considered the following alternatives and mitigation measures to be taken to minimize adverse impacts and to restore and preserve natural and beneficial values: 1) These actions must take place in a wetland because there is no other location in the area that will provide the new food manufacturing business that plans to locate on that site with (i) proximity to Interstate 91 and (ii) the ability to construct an economically feasible and functional manufacturing facility. 2) Several alternatives were considered and not selected, including: a) Several potential locations for the building additions, loading dock areas, driveway configurations, and parking locations/configurations - all of which resulted in wetland impacts that are greater than the current proposed plans. b) Location of the project outside of the wetland. However, this resulted in a building design that was not functional for the planned manufacturing uses. Other proposed sites were located out of state. c) The no action alternative was analyzed. However, this resulted in the continued vacancy of an industrial building and no new job potential. 3) Mitigation measures to minimize adverse impacts and to restore and preserve natural and beneficial values include constructing the building and driveway as proposed to keep the wetland impact as minimal as possible. Additionally, this project will comply with all state and local wetland protection procedures. The Town of Brattleboro (in collaboration with Brattleboro Development Credit Corporation) has reevaluated the alternatives to building in the wetland and has determined that it has no practicable alternative. Environmental files that document compliance with steps 3 through 6 of Executive Order 11990, are available for public inspection, review and copying upon request at the times and location delineated in the last paragraph of this notice for receipt of comments. There are three primary purposes for this notice. First, people who may be affected by activities in wetlands and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about wetlands can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in wetlands, it must inform those who may be put at greater or continued risk. VERMONT HOUSING FINANCE AGENCY NOTICE OF PUBLIC HEARING ON BONDS ISSUE Notice is hereby given that a Public Hearing will be conducted by the Vermont Housing Finance Agency (the "Agency") on the 17th day of September, 2018 at 9:00 a.m. in its offices located at 164 St. Paul Street, Burlington, Vermont, regarding the proposed issuance of tax-exempt qualified mortgage bonds in one or more series, the aggregate principal amount of which will not be in excess of $35 million, for the purpose of providing funds to finance single family mortgage loans to be made to borrowers of low and moderate income throughout the State of Vermont (the "Program"). All persons who desire to be heard on the proposed issuance of bonds are invited to attend the Public Hearing. For the convenience of interested persons, additional information relating to the Program will be available at the office of the Agency. Issuance of the proposed bonds is subject to, among other conditions, the approval of the Governor of the State of Vermont. 08/31/18
